SECOND FREEDOM OF INFORMATION REQUEST

Thank you for your response of 20th April to my Freedom of Information Request of 6th March. I reiterate the request in my email of 7th April for a copy of the reply from Lincolnshire Association of Local Councils to your request for advice as to how to respond to my original Freedom of Information inquiry.

I also request a copy of the letter dated 13rd January 2020 from the SKDC Planning Enforcement Officer regarding an alleged breach of planning control – as referenced in your minutes of the Parish Council meeting of 15th January 2020.

As you will be aware, the names and contact details of people acting in the course of their employment or public office are not personal data. I appreciate you may need to redact personal data from these letters if they mention specific residents in their personal capacity, but that should not prevent you from sharing copies.

Thank you for your email of 3rd May 2020. The Council’s response to your second FoI request is attached.

The Council wishes to point out that a formal FoI request requires a formal response. The Council must respond as required by FOIA, which entails research, consultation and approval. This is time-consuming for a small Council.

The Council tries to be as transparent as it can be to meet its commitments under the model publication scheme. It will respond as quickly and as fully as it can to requests for information, and is always happy to discuss queries and matters of interest. Ideally, requests, responses and discussions will be informal and friendly. And if the reasons or context for requests for information are known, the Council will try to tailor its response accordingly.

Hi Richard As discussed please see my ideas. I have also spoken to another expert and she has confirmed that you could use Section 40(2) for questions 1 & 2. There are risks behind this so as stated I would recommend seeking advice from the ICO.
